Sale of Freshwater Salmon Fishings
Determining the full extent of fishings by reference to the title deeds and plans.
Establishing that the Crown Estate has no ownership interest in the fishings.
Confirming the number of authorised rods and checking that there are complete records in form of Catch Records and Catch Returns to the relevant authorities.
Checking if there are any leases or time share in place.
Checking road and pedestrian access to and from fishings in terms of title deeds and common law rights.
Checking with the Registers of Scotland that there is no Community ‘Right to Buy’ Notices in place.
Negotiation and conclusion of the contract of sale.
Ordering the status report from the River Tweed Commission or equivalent authority for other salmon areas
Draft of and revision of the disposition (title deed) in favour of the purchaser.
Ordering the plan for the disposition and all matters pertaining to settlement.
Purchase of Salmon Fishings
Much as above in relation to pre-marketing and completion of contract.
Registering the disposition in favour of the purchaser and notifying the relevant public authorities of change of ownership.
Lease of Fishing or Shooting Rights
Acting for the purchaser or tenant in negotiation and completion of the lease of salmon fishings, other fishings or low/high ground shoots (grouse, partridge, deer, etc.). With specific reference to shooting rights, all documentation is drafted/revised by us to take account of the risk that the Landowner/Landlord may be found strictly liable in law for wildlife crime which is committed by other parties.
